Mynichefund (“the platform”, “we”) is operated by [Operator legal name], registered at [Registered address], company registration number [Company registration no.].
The platform is a venue. It lets an artist present a project and lets a supporter contribute money to it. We are not a party to the arrangement between an artist and a supporter. We do not vet, endorse or guarantee any project, any artist, or any statement made on a campaign page, and we are not responsible for whether a project is completed, delivered on time, or delivered at all.
A contribution is a voluntary payment to support an artist’s work. It is not an investment, a loan, a deposit, a pre-order or a purchase of shares, and it carries no right to a financial return, to repayment, or to any ownership in the artist’s work or business.
We are not a bank, a payment institution, an electronic money institution, or an investment service, and we do not hold client money. All payments are collected, held and paid out by an independent, licensed payment provider, [Payment provider], under its own terms and safeguards.
Every artist on the platform is listed under identical conditions, in alphabetical order of surname and in no other order. Nothing on the wall is ranked, featured, promoted, sponsored or paid for. The position of a campaign says nothing about its quality, its progress or our opinion of it.
Where a campaign describes a reward, perk or outcome, that promise is made by the artist alone. Any dispute about it is between the supporter and the artist, although we will help where we reasonably can (see Refunds).
To the fullest extent the law allows, we exclude all liability for loss or damage arising from the use of the platform, from any contribution made through it, or from any project presented on it. Nothing in this notice limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
2. Terms of use
2.1 Agreement
By opening the site, creating a campaign or making a contribution you agree to these terms, to the privacy notice and to the cookie notice. If you do not agree, do not use the platform.
2.2 Who may use the platform
- You must be at least 18 years old and able to enter a binding contract.
- To run a campaign you must be the artist named, or authorised to act for them, and must hold a payout account with the payment provider in your own name.
- You may not use the platform if you have been removed from it before, or if the law of your country forbids it.
2.3 Artists
- Everything you publish must be true, yours to publish and not misleading. Say what the money is for, and say how much you need.
- Use the money for the purpose described. If plans change, tell your supporters on the campaign page.
- If you promise a reward, you are responsible for delivering it and for any tax, duty or shipping it attracts.
- One campaign per project. You may not run duplicate or split campaigns to appear more than once on the wall.
- You are responsible for reporting and paying any tax due on money you receive.
2.4 Supporters
- Read the campaign before you contribute. Contribute only what you can afford to give without expecting anything back.
- You must use a payment method that is yours to use.
- You accept that a project may fail, change or be delayed, and that this does not by itself entitle you to a refund from us.
2.5 What is not allowed
- Fundraising for anything unlawful, hateful, violent, or that infringes another person’s rights.
- Offering financial returns, equity, tokens, lottery entries or anything regulated as a financial product.
- Impersonating another person, or misrepresenting your identity, location or discipline.
- Interfering with the platform, scraping it, or trying to alter the order in which artists appear.
2.6 Our rights
We may remove or suspend a campaign, withhold a payout pending checks, or close an account where we reasonably believe these terms have been broken or the law requires it. We will tell you why unless we are not permitted to.
2.7 Availability
The platform is provided as it is. We do not promise that it will be available without interruption or free of errors, and we may change or withdraw features at any time.
2.8 Changes
We may update these terms. The date at the top of this page shows the current version. Material changes will be announced on the site before they take effect. Continuing to use the platform after that date means you accept the new terms.
2.9 Governing law
These terms are governed by the law of [Country]. Disputes go to the courts of [City, Country], without prejudice to any mandatory consumer protection you have under the law of the country where you live. Consumers in the European Union may also use the European Commission’s online dispute resolution platform.
3. Fees & payouts
Mynichefund keeps a fee of 5% of what a campaign raises, deducted before payout. There are no subscriptions and no other costs: creating a profile, starting a campaign and supporting an artist are free of charge. The payment provider charges its own processing fee, currently [around 1.5 % + 0.25 €]; it is deducted before payout and shown to the artist on the campaign dashboard.
Every contribution goes to the artist, whether or not the campaign reaches its amount sought. The amount sought is a guide, not a condition: there is no all-or-nothing rule, and a campaign that ends short of it is still paid out.
Contributions are paid out to the artist’s payout account by the payment provider on [the payout schedule, e.g. weekly]. Payouts may be delayed while identity or anti-fraud checks are completed, as required by the payment provider or by law.
All amounts are shown in [EUR]. Contributions from other currencies are converted at the payment provider’s rate on the day.
4. Refunds
- Before payout. A supporter may cancel a contribution and receive a full refund at any time before the money has been paid out to the artist. Ask through the campaign page or by contacting us.
- After payout. Once money has been paid out, refunds are at the artist’s discretion, because the artist holds the money. We will pass a request on and help where we reasonably can, but cannot compel a refund.
- Campaigns that end short of their amount sought. Contributions to them are paid out to the artist like any other; ending below the amount sought is not by itself a reason for a refund.
- Removed campaigns. If we remove a campaign for breaching these terms before payout, all contributions to it are refunded in full.
- Fees. Refunds are for the full amount contributed, Mynichefund’s 5% included; payment-provider fees are returned where the provider allows it.
- Chargebacks. Please ask us for a refund rather than your bank: a refund from us costs nothing. If a supporter’s bank reverses a payment (a chargeback), the contribution goes back to the supporter and comes out of the artist’s balance. Our payment provider, Stripe, charges €20 for each such case. Mynichefund pays it, except from an artist’s second reversed contribution onwards, when it is taken from that artist’s balance and we review the account. While a bank looks into a payment, that contribution can’t be withdrawn. A card, email address or account behind a chargeback can’t be used to contribute again.
- Statutory rights. Nothing here reduces any right you have under consumer law, including a right of withdrawal where it applies.
5. Privacy notice
[Operator legal name] is the data controller for personal data processed on the platform. This notice explains what we collect and why, as required by the General Data Protection Regulation (GDPR) and applicable national law.
5.1 What we collect
- Account data: name, e-mail address, country, and for artists the discipline and campaign text you publish.
- Payment data: the amount, date and campaign of each contribution. Card and bank details are entered directly with the payment provider and never reach our servers.
- Technical data: IP address, browser type, pages visited and timestamps, collected in server logs.
- Correspondence: anything you send us.
5.2 Why we use it
- To run the platform and carry out the contract with you (Art. 6(1)(b) GDPR).
- To meet legal duties, including anti-money-laundering and tax obligations (Art. 6(1)(c)).
- To keep the platform secure and prevent fraud, our legitimate interest (Art. 6(1)(f)).
- To send you news about the platform, only with your consent (Art. 6(1)(a)), which you may withdraw at any time.
5.3 Who we share it with
The payment provider, [Payment provider]; our hosting provider, [Hosting provider]; and public authorities where the law requires. Artists see the name and contribution amount of their supporters unless the supporter chooses to contribute anonymously. We do not sell personal data.
5.4 Where it is kept
Data is stored in the European Economic Area. Where a provider processes data outside it, we rely on the European Commission’s standard contractual clauses or an adequacy decision.
5.5 How long we keep it
Account data for as long as your account exists and for [12 months] after it closes. Payment records for the period required by tax and accounting law, currently [10 years]. Server logs for [30 days].
5.6 Your rights
You may ask for access to your data, for it to be corrected, deleted or transferred, and you may object to or restrict processing. Write to [privacy@mynichefund.example]. You may also complain to your national data protection authority; for [Country] that is [Data protection authority].
7. Content & copyright
Artists keep every right in the work they show. By publishing a campaign you give us a non-exclusive, royalty-free licence to display the text and images you upload on the platform and in its search results, for as long as the campaign is live and for archive pages afterwards. We claim no other right in your work.
You confirm that you own, or have permission to use, everything you upload. If you believe content on the platform infringes your rights, tell us with the campaign name, the material concerned and proof of your right, and we will act promptly.
The platform’s name, wordmark and design are ours.
